Welcome to Yellow Hearts! These Terms & Conditions ("Terms") govern your access to and use of the website https://yellowhearts.gg and the Yellow Hearts Sparks platform (collectively, the "Service"), operated by Yellow Hearts ("Company", "we", "us", or "our").
By accessing or using our Service, signing up as a Partner, or linking your Creator profile, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
1. Overview of the Service
Yellow Hearts Sparks is a creator campaign management and discovery application designed for indie game developers, publishers, agencies, and content creators. Key features include:
- Creator discovery and public profile aggregation.
- Creator campaign creation, management, and invitation workflows.
- Automated mass outreach and Steam product key distribution.
- Credit-based access to creator profile queries and scraping features.
2. Account Registration and Authentication
A. Partner Accounts (Developers / Publishers)
- Partners must authenticate using a valid Google / Gmail account.
- You are responsible for maintaining the security of your account credentials and for all activities occurring under your account.
- You warrant that you represent a legitimate game development entity, publisher, or agency authorized to run promotional campaigns and distribute game activation keys.
B. Creator Accounts (Content Creators / Influencers)
- Creators must authenticate using a Steam account and link valid social media channels (e.g., YouTube, Instagram, TikTok, RedNote, BiliBili) to participate in campaigns and receive Steam keys.
- You represent that you are the lawful owner or authorized administrator of any linked channel or account.
3. Creator Discovery & Credit System
A. Credit Purchases & Pricing
- Certain features, including creator discovery attempts and scraping queries, require Credits.
- 1 Credit = 1 Creator Profile query / scrape attempt.
- Credits are sold in packages to Partners at designated rates published on our website or provided via sales agreements.
B. Credit Terms
- Non-refundable: All credit purchases are final and non-refundable, except where required by applicable law or explicit written agreement.
- Non-transferable: Credits cannot be transferred, resold, or redeemed for cash.
- Expiration: Credits remain active for the period specified at purchase. Unused credits may expire if explicitly stated in your tier or agreement.
- Scrape Integrity: Yellow Hearts utilizes third-party infrastructure (such as Apify and official platform APIs) to fetch publicly available data. While we strive for high availability, a credit deduction occurs upon a scrape attempt regardless of whether the third-party target platform restricts or rate-limits public output beyond our control.
4. Campaigns and Steam Key Distribution
A. Partner Responsibilities
- Game Key Validity: Partners are solely responsible for providing genuine, functional Steam keys for their promotional campaigns.
- Campaign Content: Partners must clearly define campaign parameters, coverage expectations, embargo dates, and requirements.
- Prohibited Key Uses: Mass outreach must comply with anti-spam regulations. Spamming creators with irrelevant or abusive campaigns is prohibited.
B. Creator Responsibilities
- Key Utilization: Steam keys provided through campaigns are for the Creator's personal content creation purposes (or designated giveaways if explicitly permitted by the Partner).
- Reselling Ban: Selling, auctioning, or trading received Steam keys on key-reselling marketplaces (e.g., G2A, Kinguin) is strictly prohibited and will result in immediate permanent banning from Yellow Hearts Sparks and reporting to the game publisher.
- Sponsorship Disclosure: Creators agree to comply with all applicable legal requirements regarding content disclosure (such as FTC guidelines in the US or equivalent local regulations), including declaring that a free game key or sponsorship was provided.
5. Third-Party Services and Platform Dependencies
Yellow Hearts Sparks integrates with third-party services. Your use of the Service is subject to compliance with their respective terms:
- YouTube: Integrations use YouTube API Services. By using our Service, users agree to be bound by the YouTube Terms of Service and Google Privacy Policy.
- Steam: Authentication and key features rely on Valve Corporation's API. Users agree to the Steam Subscriber Agreement.
- Data Providers (e.g., Apify): Scraping for TikTok, RedNote (Xiaohongshu), and BiliBili relies on third-party API providers.
We are not responsible for service outages, rate limits, policy changes, or termination of access by any third-party platform (Google, Steam, TikTok, RedNote, BiliBili, etc.).
6. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful, misleading, or malicious purpose.
- Attempt to bypass, compromise, or reverse-engineer the credit usage system or security controls of the platform.
- Automatically extract or scrape platform database contents outside of the intended UI features and credit mechanisms.
- Resell game keys or obtain campaign keys through fraudulent accounts or impersonation.
- Harass, abuse, or send unsolicited commercial spam to creators or developers through our outreach tools.
7. Intellectual Property
- Platform IP: All rights, title, and interest in and to Yellow Hearts, Yellow Hearts Sparks, software code, branding, logos, and UI designs belong exclusively to Yellow Hearts.
- User & Public Content: Publicly available creator metrics, avatars, and channel links displayed on the platform remain the property of their respective owners or platforms. Creators grant Yellow Hearts a non-exclusive license to display their public profile information to Partners for campaign matching.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. YELLOW HEARTS DOES NOT GUARANTEE THAT:
- CREATOR DISCOVERY SEARCHES WILL YIELD SPECIFIC CONVERSION RATES OR CAMPAIGN SUCCESS.
- CREATORS INVITED TO CAMPAIGNS WILL PRODUCE COVERAGE OR ACCEPT INVITATIONS.
- THIRD-PARTY SCRAPING SERVICES OR APIS WILL OPERATE WITHOUT INTERRUPTIONS OR RATE-LIMITS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YELLOW HEARTS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT PAID BY YOU TO YELLOW HEARTS IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
10. Termination and Account Suspension
We reserve the right to suspend or terminate your account and access to Yellow Hearts Sparks at our sole discretion, without prior notice, if:
- You breach any provision of these Terms.
- You participate in key reselling, fraud, or spam activities.
- Required by legal or third-party platform obligations.
Upon termination, your right to use the Service and any remaining credit balance will immediately cease without compensation.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Jakarta, Indonesia.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of updates by posting the revised Terms on https://yellowhearts.gg with an updated "Last Updated" date. Continued use of the Service following modifications constitutes acceptance of the revised Terms.
